                    Insurance can be confusing and downright frustrating. It doesn’t help when vague and misleading terms get thrown around by non-insurance nerds to describe policies. This seems to be especially rampant with automobile insurance coverages.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    In Florida a very popular, but misleading term is “No Fault”.  If you get into a car accident, trust me there is plenty of fault to go around, just like if you get into a disagreement with your spouse. You really think “hey baby, this is a no fault situation” is going to fly? If something is going bad its usually my fault, just ask my wife.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Well “no fault” is really short hand to reference a minimum legal amount of 1st party bodily injury insurance coverage that is required to obtain a license in Florida and it is formally known as Personal Injury Protection or PIP. 1st party insurance covers the buyer (your insurance company pays for your own hospitalization), 3rd party coverages cover someone else’s injuries or property you might have caused harm to which you are legally liable. 3rd Party insurance is usually called “liability coverage”.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    PIP was originally conceived to reduce law suits and fraud because if you were injured you would only be collecting from your own policy and insurance carrier for your bodily injury claim under $10K and thus not have to sue the the other driver and their insurance carrier. The jury is still out on whether this strategy actually reduces fraudulent claims, and there are many in favor of getting rid of PIP, but I digress.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    If you are in an accident follow the necessary procedures, call the police, get yourself medical attention and if the injuries require treatment you may be using your own “Personal Injury Protection” coverages to pay for some or all of your treatment regardless of who actually caused the accident. PIP is the bare minimum in coverage and should not be relied on to make you and your family whole for your hospitalization costs, lost income, medication, medical bills, and surgeries in a major accident.

Imagine a sewer back up happens in your home and you find out you are not covered for this loss, (not a good day).  Also, another valuable endorsement is replacement cost instead of the depreciated actual cash value. At the time of a loss you do not want to find out your $2500 TV is now worth $250, or the $10,000 dollars in furniture you own is now valued at $1,000.

Match these limits with your regular liability levels when financially possible.

      You have two options. The first one is to hope that you will receive federal disaster relief if a flood damages your property. Many people are under the misconception that the government will take care of their financial needs should they suffer flood damages. The truth is that federal disaster assistance only becomes available once the president formally declares a disaster. Even if you receive disaster assistance, it often comes in the form of a loan you will have to repay with interest. Of course, these payments are in addition to your regular mortgage payments.

      That being said, you must consider the possibility that if your home becomes flooded and you are not offered disaster assistance, you should consider the massive damage costs alone.       Your other option is to buy flood insurance and stay protected, no matter what. When disaster strikes, flood insurance policyholder claims are paid, even if a disaster is not federally declared. Flood insurance means that you’ll be reimbursed for all of your covered losses. And unlike federal aid, it never has to be repaid. Typically, a policy does not take effect until 30 days after you purchase flood insurance. So, if the weather forecast announces a flood alert for your area, it’s already too late to purchase coverage.                     If you’re at all confused about how much renter’s insurance you’ll need, we suggest calculating the cost of everything you would want to replace if it were damaged or stolen. Think of it as a basis for an inventory; it’ll make filing a claim easier if you ever have to. Make sure to include record model numbers, dates, and places of purchase. Include photos or videos of the items, and place a copy of the inventory in a safe place, away from your home. If anything were to happen, you wouldn’t want those important files to be damaged too!

                    We’ve mentioned before that our state senator, representative and Insurance Commissioner have asked FEMA for transparency on the National Flood Insurance Program. Since this request for information, tides have been changing for private Florida flood insurance.  Recently a few local, private insurers have taken to task underwriting flood insurance in an effort to regulate rates, which have spiraled out of control for many Floridians. Let’s take a look back at how flood insurance became a four-letter-word and what our private insurance companies are doing to rectify the issue and make flood insurance palatable for homeowners on flood planes.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    It’s well known that flood insurance is a separate coverage from homeowner’s insurance. It’s necessary for mortgage lenders as well as federally mandated for people who live in flood zones. This is because lenders want to make sure that the properties they finance are protected from any flood damage. Likewise, if you live in a high risk area, the government does not want you to suffer extensively if and when your home is damaged.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Before 1960 many private insurance companies offered flood insurance. At the time they were able to successfully underwrite and pay out claims caused from flood damage. After massive, ultimately expensive, flooding of the Mississippi River in the 1960s those private insurers pulled out of the game leaving the federal government to take care of citizens affected by flooding.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Since then the National Flood Insurance Program, or the NFIP, has bore the cost and weight of a majority of the flood insurance policies in the United States. Only a few private insurers have been brave enough to step into the market. And, those insurers have only been willing to cover properties under certain conditions and backed by huge surplus lines providers, like Lloyd’s of London. Change has been spotty at best, but for a state that holds 37 percent of all NFIP polices it’s a necessary one.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Up until recently, the cost of Federal Flood insurance was reasonable. However, recent changes to to the program have hiked prices for Floridians up to 20 times higher. Our policy makers have concluded that the only way to fix this problem is to open the market and let private insurers in. Hence the request for FEMA information.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Many policy holders may be wondering how exactly private insurers intend to break into the market. And how, if the rates are so inflated, they intend to properly adjust cost to cover any claims? The answer lies in the advancement of technology. Current flood mapping, risk data and computer monitoring have made it easier and more accurate for insurers to predict the likelihood of flood damage. With this new, more accurate information private insurers believe they will be able to properly determine the levels of insurance they can provide. As in any free market system, there will eventually be many options for homeowners to choose from, rates will become competitive and fall within a range that is comfortable for homeowners of varied incomes.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    There is certainly an untapped market for private insurers breaking into the flood insurance game. With Federal insurance raising to near impossible-to-afford rates, many homeowners, who are not bound by mortgage or federal mandate, are going without. The consequences for going without flood insurance are costly to say the least.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Allowing private insurers to enter the market will allow homeowners to choose policies that fit their needs as opposed to taking what they can get with the current federally offered on-size-fits all policies. Sen. Jeff Brandes brought in legislation last year to allow these private insurance to tailor flood policies for individual policies. It will allow insurance companies to make policies for homeowners that will be affordable and subject to their needs.  In other great news for flood insurance reform, a bill is in congress that will clarify that private insurers can provide the federally mandated insurance for flood-prone areas.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    It’s exciting to see that so many legislators and private insurance companies are on board for reforming flood insurance for Floridians. As our industry takes a historic step in helping our clients by providing a coverage desperately needed and, legally necessary, affordable and individualized as their home insurance policies. As these bills become laws and insurance underwriters come on board, we will be sure to keep you informed of your new flood insurance options.

                    It was recently reported that nearly 300,000 policy-holders who do not have mortgages nor lender requirements have decided to forgo the coverage. As independent insurance agents we see first hand the damage a flood can do, and this concerns us. We don’t like to see cost prohibit people from having the coverage that they need. We certainly hope that the data requested is released so Florida State Lawmakers can begin to allow for private insurance to enter the market.

                    We hope that an agreement can be made soon, that private insurers are able to enter the flood insurance marketplace and create lower rates that will be beneficial and affordable for homeowners to purchase. It’s difficult dealing with the aftermath of a flood, and even more so when you are uninsured.

To provide this insurance the state of Florida created the non-profit, tax exempt corporation. The decision to reduce the amount of policies held by Citizens is in an attempt to reduce the risk to taxpayers should another catastrophic hurricane make landfall.

                    Because Florida hasn’t seen a hurricane in 10 years, private insurers are more inclined to write policies due to growing surpluses and reinsurance. This move to private insurance from Citizens will no doubt benefit the insured. While Citizens provided many who were unable to purchase insurance with much-needed coverage, private insurance that is now available will provide much more robust coverage at reasonable rates.

     says that there are 144 damaged streets that could cost $15 million to repave. Improving, updating, and fixing damaged storm drainage systems is estimated to cost $92.5 million. She added that without additional funding, the repairs could take around 74 years to complete.

                    This is an astonishing amount of time and money needed to repair infrastructure, and doesn’t even take into account the 300 damaged and 46 destroyed homes that were left in the storm’s wake.

                    Flooding causes serious damage, and being without flood insurance is a definite risk. It’s unclear how homeowners are fairing in the aftermath of the storm. Or, how much it will cost them to repair or rebuild their homes. Those who were covered have most likely moved on after completing repairs with little to no hassle. Those who did not have the extra coverage are dealing with the repairs completely on their own.

                    With the NFIP’s data, private insurance companies would be able to audit how the federal government makes their rates. With this information, Hagar said, “We can at minimum reach our own judgment, and to the extent that we believe Floridians are being gouged, and we do believe they’re being gouged, we can turn up the heat on our Florida delegation on this issue.”
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;

                    Because the NFIP is a federal program, private insurance and the states they reside in have no jurisdiction over the rates. If Florida insurers were able to see if their policyholders were being charged unnecessarily high rates, they would be able to appeal to law makers to open flood insurance to the private marketplace.

  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    By opening up the flood insurance to the private insurance marketplace, rates will be regulated. They would be market driven as well as loss driven, and more fairly priced based on raw data that insurance agents can analyze.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    This is a very interesting time to be a Florida insurer. If the NFIP releases its data to the Florida Insurance Commission, sweeping change may be in the works.      the Florida Third District Court of Appeals dismissed a case pertaining to the constitutionality of our state’s workers’ comp system. The case was dismissed citing procedural issues, and the plaintiffs have requested the Florida Supreme Court look at the case.

&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    The case’s history began in 2010 when a worker was injured on the job. He and other injured workers were forced to retire due to long-term effects of the injury. In 2013 employee advocacy group took on the case and noticed that a provision of the Florida Workers’ Comp law added in 2003 no longer gave workers a fair deal.
                  &#xD;
  &lt;/p&gt;&#xD;
&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
    
                    Over years of being litigated, the district court decided that the case itself had strayed from it’s original intent and thus dismissed the case. Now it will be up to the Florida Supreme Court to deicide the constitutionality of the current Workers’ Compensation Law, should they decide to hear it.

&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;p&gt;&#xD;
